Curekey Terms of Service

By accessing or using the Curekey website, mobile site, and related services (collectively, the “Website” or “Platform”), you agree to be bound by these Terms and Conditions (the “Terms” or this “Agreement”). These Terms form a binding agreement between you and Curekey LLC (“Curekey,” “we,” “us,” or “our”). If you do not agree, do not access or use the Platform.These Terms apply to all content, features, and services offered by Curekey, including non-clinical services we provide and access to independent, third‑party medical groups and licensed clinicians that may deliver telehealth services through the Platform (the “Medical Groups” and “Providers”), as well as third‑party pharmacies that may dispense medications (“Pharmacies”). Additional terms or policies (e.g., our Privacy Policy, Consent to Telehealth, Notices of Privacy Practices from Medical Groups, and any product‑specific policies) are incorporated by reference.

1) Key Definitions

  • User: An individual who creates an account, browses, purchases, or otherwise uses the Platform.
  • Services: Non‑clinical services provided by Curekey (e.g., account, payments, logistics, customer support), and access/coordination with independent Medical Groups/Providers and Pharmacies.
  • Products: Prescription and non‑prescription items (including compounded preparations) offered through the Platform.

2) Eligibility & Geographic Availability

  • You must be 18+ and capable of forming a binding contract.
  • Telehealth services and prescription access are state‑specific and may not be available in every U.S. state. To receive clinical services, you must be physically located in an available state at the time of your visit and truthfully attest to your location. Services are not available outside the United States.
  • We may deny or discontinue Services if eligibility, identity, or location cannot be verified, or if clinically inappropriate.

3) Relationship with Medical Groups, Providers & Pharmacies

  • Curekey is not a medical group or healthcare provider and does not practice medicine. Medical Groups and Providers are independent third parties solely responsible for the clinical services they provide, including diagnosis, treatment decisions, and prescribing.
  • Pharmacies are independent professional entities solely responsible for the dispensing of medications and related professional services.
  • By using the Platform, you may establish a patient‑provider relationship with a Medical Group/Provider—not with Curekey. Curekey provides the technology, logistics, and non‑clinical support.

4) Consent to Telehealth & Non‑Emergency Use

  • By using the Platform to seek care, you consent to receive telehealth services (e.g., synchronous/asynchronous telemedicine, remote review of information, secure messaging, electronic prescriptions), subject to your state’s laws and the Medical Groups’ informed consent.
  • The Platform is not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency department.

5) Not Insurance; No Guarantee of Results

  • Curekey is not an insurer and Services are not insurance. You are responsible for all fees not covered by any insurance.
  • Hair‑loss outcomes vary by individual and are not guaranteed.

6) Accounts, Security & Accurate Information

  • You may need an account to use portions of the Platform. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
  • You agree to provide true, accurate, current, and complete information (including identity, age, location, medical history, and payment info) and to keep it updated.
  • Notify us immediately at support@curekey.com of any unauthorized access or suspected breach.

7) E‑Sign Disclosure & Communications Consent

  • You consent to transact electronically and to receive electronic communications, including messages from Curekey, Medical Groups/Providers, and Pharmacies about your care.
  • Email and SMS may be unencrypted and could be intercepted. By providing your email/phone or initiating text/email communication, you accept these transmission risks.
  • You may opt out of non‑essential marketing messages by following the instructions in those communications. Transactional/critical messages may still be sent.

8) Prescriptions, Clinical Appropriateness & Pharmacy Fulfillment

  • Prescriptions are issued only if a Provider determines they are clinically appropriate. A consultation does not guarantee a prescription.
  • Providers may prescribe FDA‑approved drugs used on‑label or off‑label and/or compounded medications prepared by licensed compounding pharmacies. Compounded medications are not reviewed or approved by the FDA for safety or efficacy and may carry unique risks.
  • If prescribed, medications may be dispensed by Pharmacies selected by you or your Provider, subject to state law. You authorize the sharing of necessary information among Curekey, Medical Groups/Providers, and Pharmacies to coordinate care, payment, and fulfillment.

9) Important Drug & Safety Disclosures (Hair‑Loss Therapies)

  • Common hair‑loss ingredients include finasteride, dutasteride, minoxidil, spironolactone, tretinoin/retinoids, corticosteroids, among others. Topical finasteride and dutasteride, and many compounded combinations, are not FDA‑approved. Oral finasteride is FDA‑approved for androgenetic alopecia; dutasteride is FDA‑approved for BPH and commonly used off‑label for hair loss.
  • Potential risks/side effects vary by medication and route (oral vs. topical) and may include local irritation, shedding phases, systemic effects (e.g., sexual dysfunction, blood pressure changes for minoxidil, pregnancy risks for certain agents), and drug interactions. Read all medication guides, ask questions, and discuss concerns with your Provider.
  • Report adverse events promptly to your Provider and to support@curekey.com. In an emergency, call 911.

10) Orders, Shipping & Delivery (U.S. Only)

  • We currently ship only within the United States. We may reject orders to addresses outside the U.S.
  • Initial prescription orders may require completion of identity verification and submission of requested photographs or documents. Orders will not process until required steps are completed.
  • Subscriptions (if selected) are typically shipped on a cadence intended to prevent treatment gaps. Shipping dates are estimates and may vary. Risk of loss passes to you upon delivery to the carrier. We are not responsible for delays or delivery issues caused by third‑party carriers or incorrect/incomplete addresses provided by you.
  • To change your shipping address, please update your account or contact support at least three (3) days before your next bill date.

11) Pricing, Billing, Auto‑Renewals & Cancellations

  • You authorize Curekey (or our payment processor) to charge your payment method on file for one‑time purchases and any auto‑renewing subscriptions you select, at the then‑current price plus applicable taxes and shipping.
  • Auto‑Renewal: Subscription plans renew automatically until you cancel. To avoid the next renewal, cancel no later than three (3) days before your next bill date. Orders in Processing/Shipped/Completed status cannot be canceled.
  • You can manage your plan in your account or by emailing support@curekey.com.
  • We may suspend or deactivate accounts that remain inactive or unverified for 120 days after purchase or registration. Unless required by law, refunds are not provided for inactivity‑based deactivations after the 120‑day window.

12) Returns, Refunds & Limited Guarantee

Prescription Products: Due to pharmacy law, prescription medications generally cannot be returned once dispensed. If you believe a product is damaged, defective, or incorrect, contact support@curekey.com within 7 days of delivery with photos and your order number. We may, in our sole discretion, offer a replacement or refund.Non‑Prescription Products & Devices: Unopened items in original packaging may be returnable within 30 days of delivery. You are responsible for return shipping unless prohibited by law.Limited Hair‑Loss Guarantee (if offered): At our discretion, we may offer a limited guarantee on your most recent month’s prescription product only. If you are unsatisfied within six (6) months of starting treatment, contact support@curekey.com with subject line “Guarantee Return Request” and follow the instructions we provide. If approved, and after receipt/verification of any required return(s), we will refund the price paid for your most recent month’s supply (less shipping/handling and applicable fees). This guarantee does not apply to non‑prescription products or prior months and may be changed or discontinued at any time.

At Curekey, we are committed to delivering a safe, transparent, and reliable healthcare experience.

Due to the medical and personalized nature of our services, our refund policy is governed by the

following terms:

a. Medical Consultations

Fees paid for medical consultations (including review of medical questionnaires by licensed

healthcare providers) are non-refundable, regardless of whether a prescription is issued. This

applies even if the provider determines that treatment is not medically appropriate.

b. Prescription Orders

Once a prescription has been issued and sent to the partner pharmacy, no refunds can be granted,

even if the patient chooses not to use or receive the treatment. Prescription medications cannot be

returned or exchanged, in accordance with applicable regulations.

c. Delivery Issues

In the event of significant shipping delays, lost packages, or damaged products upon delivery,

patients must contact our support team within 7 days of the expected delivery date. Each case will

be reviewed individually in coordination with the dispensing pharmacy, and we may offer a

replacement shipment or partial refund if appropriate.

d. Order Cancellations

Orders may be cancelled only if the prescription has not yet been transmitted to the pharmacy. After

that point, cancellations and refunds are no longer possible. To request a cancellation, please

contact our support team immediately at support@curekey.com.

e. Disputes & Claims

Any claims related to charges or orders must be submitted within 30 days of the transaction date.

We will be unable to process claims submitted beyond this period.

13) Acceptable Use

You agree not to misuse the Platform, including by: (a) violating any law; (b) infringing IP or privacy rights; (c) sending spam or running unconfirmed messaging lists; (d) engaging in fraud, harassment, or security violations; (e) introducing malware; (f) scraping or reverse‑engineering without permission; (g) misrepresenting your identity, clinical information, or location; or (h) attempting to resell Products or Services. We may suspend/terminate accounts for violations, without refund where permitted by law.

14) Intellectual Property

The Platform and its content are owned by Curekey or its licensors and are protected by IP laws. You may access the Platform for your personal, non‑commercial use only. No licenses are granted except as expressly stated.

15) Privacy

Your use of the Platform is subject to our Privacy Policy. Medical Groups may provide separate HIPAA Notices of Privacy Practices. By using the Platform, you consent to our and our partners’ collection, use, and sharing of information as described in those notices.

16) Disclaimers

THE PLATFORM, SERVICES, AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUREKEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. Without limiting the foregoing, we do not guarantee uninterrupted or error‑free operation, or any particular clinical outcome.

17) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CUREKEY OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOSS OF DATA, PERSONAL INJURY, OR EMOTIONAL DISTRESS), EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE PLATFORM, SERVICES, OR PRODUCTS SHALL NOT EXCEED THE AMOUNTS YOU PAID TO CUREKEY IN THE THREE (3) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.Some states do not allow certain limitations; in such states, our liability is limited to the fullest extent permitted by law.

18) Indemnification

You agree to indemnify, defend, and hold harmless Curekey and its affiliates from and against all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Platform; (b) your breach of these Terms; (c) your violation of law or rights of any third party; or (d) your clinical disclosures or conduct.

19) Dispute Resolution; Arbitration; Class Waiver

PLEASE READ THIS SECTION CAREFULLY. It affects your rights.Informal Resolution. Before filing a claim, you agree to try to resolve the dispute informally by emailing support@curekey.com with a description of the dispute and relevant information. If we cannot resolve it within 60 days of receipt, either party may start arbitration as described below.Binding Arbitration. Except for the small‑claims carve‑out and IP/urgent relief described below, any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, Services, or Products (collectively, “Disputes”) will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act (FAA) governs this section. The arbitration will take place in Wilmington, Delaware (or by video/telephonic appearance as the arbitrator permits). Each party will bear its own attorneys’ fees, unless a statute provides otherwise. AAA fees will be allocated under the AAA’s rules.Class Action & Jury Trial Waiver. You and Curekey agree to arbitrate Disputes only on an individual basis and waive any right to a jury trial or to participate as a plaintiff or class member in any purported class, collective, consolidated, private attorney general, or representative proceeding.Mass‑Filing Administrative Mechanism. If 100 or more substantially similar arbitration demands are filed by or with the same law firm/organization within a 30‑day period, the parties agree to batch administration: the AAA will (i) administer in batches of 100 (plus a final batch of the remainder); (ii) appoint one arbitrator per batch; and (iii) resolve each batch with one set of administrative filings and schedules per side. An administrative arbitrator may decide applicability of batching.Carve‑Outs. Either party may bring individual claims in small‑claims court within that court’s jurisdiction. In addition, either party may seek injunctive or equitable relief in court to protect intellectual‑property rights or address unauthorized access or misuse of the Platform.Opt‑Out. You may opt out of arbitration by sending a written notice with your name, account email, and statement of your decision to Curekey LLC, Attn: Arbitration Opt‑Out, 16192 Coastal Highway, Lewes, County of Sussex, Delaware 19958 within 30 days after you first agree to these Terms. Opting out will not affect other terms.Severability. If a court finds that the class‑action waiver is unenforceable for a particular claim, that claim must proceed in court (not arbitration), but the remaining arbitration terms will still apply. Other unenforceable provisions will be severed to the extent permitted, and the remainder enforced.

20) Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict‑of‑laws principles, and by the FAA for arbitration issues. Subject to the arbitration provision, the exclusive venue for claims that must be filed in court will be the state or federal courts located in New Castle County, Delaware, and you consent to their personal jurisdiction.

21) Changes to the Platform & Terms

We may modify or discontinue the Platform (in whole or part) at any time. We may update these Terms from time to time; changes are effective when posted with an updated “Last Updated” date. Your continued use after changes become effective constitutes acceptance of the revised Terms.

22) Other

  • We may limit purchases to end‑users and refuse or cancel orders placed by resellers.
  • Headings are for convenience and do not affect interpretation. If any provision is found unenforceable, the remaining provisions remain in effect.
  • You may not assign these Terms without our prior written consent; we may assign them without restriction.

Curekey does not offer or ship medications in jurisdictions where it is not licensed. Compounded medications are prepared by partner pharmacies;compounded products have not been reviewed by the FDA for safety or efficacy. If you experience a medical emergency or severe adverse reaction, call local emergency services immediately.
